In NYC a ZRD1 is a Zoning Resolution Determination. This is an application to get a written ruling from the Department Of Buildings on the interpretation of a specific Zoning Code.

If you have a concern about a specific Zoning Code and need clarification you can file a ZRD1. There are a few circumstances in which this can be done.
- Request for Variation of Code
- Appeal DOB Plan Exam Objection
- Appeal of ZRD1 Determination
A predetermination is when you have a concern of a zoning code before you have filed with the Department Of Buildings. You can ask the DOB to look into your one specific zoning issue and they may issue a predetermination. You can later use this ZRD1 if you get an objection from a plan examiner after you file.

Request For Variation of Zoning Code ZRD1
A request for variation of code may be a situation where you may not interpret the applicability of a code but a different code or interpretation.

Appeal of DOB Plan Exam Objection ZRD1
After you file your plan examiner may issue you an objection. You must make an appointment to review the objection with the plan examiner as per ZRD1 requirements:
“Appeal of an affirmation of an objection after a second plan examination review”
If you have had your second review and the plan examiner provides affirmation of the objection but you still disagree you can appeal with a ZRD1. You must have the second review first.

Appeal Previously Denied ZRD1
You can file a ZRD1 in order to appeal a previously denied ZRD1.

ZRD1 Applications to DOB
There is only one issue per ZRD1. You cannot file a ZRD1 for multiple zoning codes. If you have more than one issue you must file and pay fees for each issue separately.
